Kuryshev E. Yu. Legal positivism and normative theory of law

Abstract. The law is undergoing systematic updates. In the era of the digital society, the updating of law and the legal system takes on a distinctive character. This distinctiveness is manifested in the formation of innovative law, taking into account the theory of legal positivism and normative legal theory. In addition to existing scholarly perspectives, the article examines the main points of intersection between normative legal theory and the process of innovation in law. The author outlines the types of innovations in law and provides a brief description of each. New forms of innovation in law and their impact on the practical activities of government bodies are explored. It concludes that the modern Russian state plays a crucial role in the application of innovations in law, facilitating the enhancement of the legal system and its fundamental element — the system of law. In the context of legal positivism and normative legal theory, the main aspects of integrating innovations into Russian legislation are outlined.
