Chukin D. S. Basic social structure as a prerequisite for justice

Abstract. Despite the fact that justice is included in the list of classical topics of philosophy and theory of law, the work on creating a meta-theory of justice has not led to satisfactory results for all interested parties. The origins of law enforcement justice should be sought in the social structure of society, since law is a social construct. Modern societies are characterized by an extremely heterogeneous structure, which significantly complicates the search for a universal theory of justice. The social structure is strongly influenced by the value background, which consists of traditions, customs, and everyday habits that are formed over the course of history and include, among other things, ideas about justice. The realization of justice in law, therefore, requires a flexible approach based on common sense, experience, and extensive knowledge of law enforcement entities.
