Chukin D. S. Areas of concern of principle of justice implementation by a law enforcement officer

Abstract. Comprehension of law and law enforcement is impossible without understanding its correspondence to justice. Justice is both a fundamental legal principle and the purpose of law enforcement. Meanwhile, a number of branches of home legislation do not operate the concept of justice keeping it from full enforcement and requiring inclusion of justice as an multisectoral universal principle at the legislation level. Constitutional Court is noted as one of the key instances executing the principle of justice supervision in the Russian Federation. It realizes this function in its decisions by determining the constitutional nature of a particular legal norm. It is concluded that the two main factors keeping the principle of justice from full enforcement are the shortcoming of the legal norm and the incompetence of the law enforcement subject.
